Sampling (music) - Wikipedia, the free encyclopedia
Music workstations and samplers use samples of musical instruments as the basis of their own sounds, and are capable of playing a sample back at any pitch.
Sampling is also possible with tape loops or with vinyl records on a phonograph.
In music, sampling is the act of taking a portion of one sound recording, the sample, and reusing it as an instrument or element of a new recording.

What is the Law Regarding Sampling?
Sampling without permission violates two copyrights-the sound recording copyright (usually owned by the record company) and the copyright in the song itself (usually owned by the songwriter or the publishing company).
Sampling is the use of portions of prior recordings which are incorporated into a new composition.
These provisions constitute a promise that you created all the music on your album and an agreement to reimburse the label if it is sued.

TAXI FAQs: Copyright Information: Music, Money, and Sampling
There are many definitions of the word "sampling"; in briefest terms, it is when a songwriter, recording artist or record producer takes a portion of an existing song, existing recording, or both and puts them it into a new song, recording or both.
If the sample is not approved, the sample can be deleted from the recording before it is released without any harm to the new recording artist, record producer, record company, songwriter and music publisher.
As part of any negotiations, the music publisher or record company owning the sampled composition or master recording will request a copy of the new recording for review, review of the sampled section, and determine its importance and value to the new song or record.

Recording devices, and digital technologies in particular, turn prior recorded sound into the raw material for new work.  Samplers have replaced electric guitars as tools of the trade for many musicians; remixes and sonic collage are musical staples from the Top 40 to obscure electronica and hip-hop.
Musicians on this panel will demonstrate the digital manipulation of preexisting recordings and MIDI files and discuss the impact of digital technology on music production and music theory.  An experienced music attorney will discuss the legal consequences of the particular practices demonstrated by the musicians, as well as the law's overall responses to digital music.

"Sampling and New Independent Dance Labels: The Importance of Understanding Copyright Law"
As the music industry in the UK continues to develop an increasingly formalised approach to music business education (by virtue of a wide range of taught courses up to Masters level), then the next generation of record label managers may perhaps be more educated with regard to copyright and sampling.
Indeed, note that music publishers are usually contractually obliged to perform the role of legal guardian and custodian of their songwriter's copyrights.
Music Week highlighted the success of dance music as a contributory factor to increased sampling, and cited John Fogerty as saying that “the new breed of artists don’t seem to understand or want to understand the whole essence of copyright … what we must do is educate people …”.
