Topic: Reasonable Doubt

 Beyond reasonable doubt
In British trials, there is a presumption of innocence - it is for prosecutions to prove "beyond reasonable doubt" that defendants are guilty, not for defendants to prove their innocence.
It is only meant to show that, with some reasonable estimates of the likelihoods of relevant events, the scales come down on the side of her innocence rather than her guilt.
Using the figure of 1 in 1,303 for the chance of a first cot death, we see that the chances of a second cot death in the same family are somewhere between 1 in 60 and 1 in 130.

 Beyond Reasonable Doubt
The legal presumption of innocence (and the corresponding requirement that guilt must be proved 'beyond reasonable doubt') would then be reflected in this high threshold, which ensures that defendants will be acquitted unless the jury considers that the probability that they are innocent is extremely low.
But it violates what I understand to be the principle of presumption of innocence.
I am not concerned with a debate about the level at which this threshold should be set, but about whether the probabilities of guilt or innocence are indeed the ones that should be addressed.
